A common question is,"what is the difference between a DUI and an OVI?" However, there is no longer a requirement in Ohio that the vehicle involved must be 'motorized.' You can even be at risk of a DUI, OVI or DWI charge by riding a bicycle under the influence of alcohol or drugs. There is also a Physical Control charge, which is similar to a DUI in that it that deals with simply 'being' in a vehicle while under the influence of alcohol or drugs. A Physical Control charge does not require the vehicle to have been driven or even started. This charge is most common when someone tries to "sleep it off," rather than attempt to drive impaired.
